Master Definitions
These defined terms apply across all documents in the Being Optimal legal suite unless a specific document expressly defines a term differently for that document only. Capitalized terms not defined here have the meanings given in the document where they appear.
Parties & relationships
Being Optimal, we, us, or our means [PENDING: LEGAL_ENTITY_NAME], trading as Being Optimal, Site Nutrition (product surfaces may also say “Site Nutrition”).
you or User means the individual who creates an account, uses the Services, or accesses public pages.
Clinician or healthcare provider means your licensed medical or midwifery professional. Being Optimal is not your Clinician.
Services & infrastructure
Services means the Being Optimal pregnancy-nutrition technology platform, including the nutrition dashboard (planner), account surfaces, Learning Center, help materials, AI assistant, community forum (where enabled), Certified / brand surfaces, APIs used by the product, and related documentation — as made available at beingoptimal.org and associated subdomains (including https://help.beingoptimal.org, https://community.beingoptimal.org, https://assets.beingoptimal.org).
Authentication Provider means the third-party service used for user authentication and session management (currently Clerk).
Database Provider means the third-party service used for the application database and related data services (currently Supabase).
Hosting Provider means the third-party platform used to host the web application (currently Vercel).
Cloud Infrastructure Provider means the third-party cloud platform used for backend compute and object storage (currently Google Cloud).
CDN / Edge Network Provider means the third-party edge and DNS service (currently Cloudflare).
Email Delivery Provider means the service used to send transactional email (currently Amazon SES).
AI Model Providers means third-party large-language-model services used by the AI assistant (currently Anthropic, xAI, OpenAI).
Community Platform Provider means the forum software/host used for community discussions (currently Discourse).
Reverse-Geocoding Provider means the service that converts device coordinates to place names (currently BigDataCloud).
Billing Provider means the external merchant-of-record / subscription billing service that processes paid plans when live (currently Clearway (placeholder — not yet live)). Being Optimal does not store full payment card numbers.
Provider role terms are used generically so vendors can be substituted without re-drafting. The current named identity of each role is disclosed in Sub Processor List.
Sub-processor means a third party engaged by Being Optimal to process Personal Data on our behalf, as listed in Sub Processor List.
Product concepts
Environment means a user workspace within the product (e.g., a pregnancy profile / planning context) that holds meals, journal, and related data.
Meal means an eating occasion slot (e.g., Breakfast) holding ingredient quantities.
Combo means a reusable dish/ingredient preset that can be loaded into a Meal.
Template means a full-day meal preset across slots.
Day Score or Grade means an informational nutrient-alignment score/grade produced by the engine for a logged day — not a medical diagnosis or clinical decision.
Borg means the in-product AI assistant that may send conversation and health-context snippets to AI Model Providers and may persist conversation content.
Special Category Health Data means data revealing health status or related sensitive categories under GDPR Article 9 and similar laws — including pregnancy timing (LMP/EDD), DOB, ethnicity (where collected), weight, blood-marker labs, symptoms, and meal logs used for nutritional inference.
Nutrient Data Source means public or licensed nutrient composition data used in the catalog (currently USDA FoodData Central). This is not a Sub-processor of Personal Data.
Outbound partner click means a recorded click on a partner/affiliate link. Stored click records are designed to be pseudonymous (no user id; IP used transiently for rate limiting only).
Data & compliance roles
Personal Data means information relating to an identified or identifiable natural person under applicable Data Protection Laws.
Data Protection Laws means applicable privacy and data protection legislation, including GDPR, UK GDPR, CCPA/CPRA, Singapore PDPA, Australian Privacy Act, Hong Kong PDPO, and other laws referenced in regional annexes to the Privacy Policy.
Controller means the entity that determines the purposes and means of processing Personal Data.
Processor means the entity that processes Personal Data on behalf of a Controller.
Automated Decision means a decision or output produced by automated processing, as inventoried in Automated Decisions.
Records of Processing Activities (RoPA) means accountability records under GDPR Article 30 (and equivalents), set out in Records Of Processing.
