LegalCommunity Guidelines & UGC Terms
Community Guidelines & UGC Terms
1. Purpose and scope
1.1 These Community Guidelines & User-Generated Content Terms (“Guidelines”) apply to the Being Optimal community forum at https://community.beingoptimal.org and any related discussion surfaces we designate (together, the “Community”).
1.2 The Community is provided by [PENDING: LEGAL_ENTITY_NAME] (“Being Optimal,” “we,” “us”) using software and hosting from a Community Platform Provider. These Guidelines form part of your agreement with us and are incorporated into the Terms of Service. The Acceptable Use Policy also applies.
1.3 Participation is optional. You may use core planner features without posting in the Community.
1.4 Not a clinical service. The Community is for peer support, product feedback, and educational discussion about nutrition and pregnancy wellness in general terms. It is not telemedicine, midwifery, or emergency care. See the Medical Disclaimer.
2. Eligibility and accounts
2.1 You must meet the age and eligibility rules in the Terms (minimum age 18, self-attested).
2.2 Community access may require a Being Optimal account and acceptance of these Guidelines, the Terms, Privacy Policy, Medical Disclaimer, and Acceptable Use Policy.
2.3 One person, one primary account. Impersonation, ban evasion, and credential sharing to evade moderation are prohibited.
2.4 Staff and moderators. Official staff accounts may be labeled. Treat moderation instructions as binding for Community participation.
3. Single sign-on (SSO) and identity
3.1 Where enabled, you may sign into the Community via SSO from the main Being Optimal application (Authentication Provider session).
3.2 What SSO is designed to share: identity attributes needed to create or link a forum profile — typically email address, display name or username, and a stable account identifier — as configured with the Community Platform Provider.
3.3 What SSO is not designed to share: pregnancy timing (LMP, EDD, gestational age), meal logs, blood markers, Day Scores, AI assistant conversations, or other Special Category Health Data from your planner Environment. Those data remain in the main application data stores under the Privacy Policy and are not pushed to the forum via SSO.
3.4 What you choose to post is different. If you voluntarily write health details in a public or private Community post, that content is UGC you chose to disclose and is subject to these Guidelines, forum visibility settings, and the Privacy Policy’s community sections.
3.5 Forum profiles, posts, and uploads are processed on Community Platform Provider infrastructure. See the Privacy Policy and Sub Processor List.
4. Core conduct standards
4.1 Expected behavior
- Treat others with respect; assume good faith when safe to do so.
- Stay roughly on-topic: pregnancy nutrition, product use, learning content, and related lived experience.
- Use content warnings where appropriate for graphic medical detail or loss.
- Cite sources when making strong factual claims about nutrition science when you can.
- Respect privacy: do not dox or share another person’s private information without consent.
4.2 Prohibited behavior
Without limiting the Acceptable Use Policy, you may not:
- Harass, threaten, stalk, or incite violence against anyone;
- Post hate speech, slurs, or content that demeans people based on protected characteristics;
- Sexually exploit or endanger minors (zero tolerance; we will report as required);
- Spam, scam, phishing, or undisclosed commercial solicitation;
- Scrape the Community or harvest user data;
- Attempt to bypass bans, rate limits, or security controls;
- Post malware, malicious links, or attempt unauthorized access;
- Infringe others’ intellectual property (see Copyright & DMCA);
- Share another user’s private messages without permission;
- Impersonate Being Optimal staff, clinicians, or other users.
5. Health discussion rules (critical)
5.1 Peer support ≠ medical advice
5.1.1 Users must not present themselves as providing professional medical, midwifery, dietetic, or pharmacological advice as a substitute for care from a licensed Clinician.
5.1.2 Sharing personal experience (“what I ate / what my midwife suggested for me”) is generally allowed if framed as personal, not as a prescription for others.
5.1.3 You must not pressure others to ignore clinical advice, stop prescribed treatment, or avoid emergency care.
5.1.4 Emergencies. If someone appears to be in medical distress, urge them to contact local emergency services or their Clinician. Moderators may lock threads that become crisis-handling beyond peer support. Being Optimal is not an emergency service.
5.2 Health misinformation and dangerous guidance
We may remove or limit content that, in our reasonable judgment:
- Promotes clearly dangerous pregnancy practices (e.g., encouraging alcohol bingeing, raw high-risk foods as “safe for all,” megadoses of retinol/vitamin A beyond clinical guidance presented as harmless, or avoiding prenatal care);
- Spreads demonstrably false claims presented as settled fact where harm is reasonably foreseeable;
- Markets unproven “cures” or supplements with disease claims that are unlawful or deceptive;
- Encourages disordered eating or extreme restriction in pregnancy without clinical framing.
Good-faith scientific uncertainty and discussion of evolving evidence is allowed; bad-faith harm is not. Moderators are not a scientific journal; enforcement is pragmatic and safety-oriented.
5.3 Product scores and AI outputs
Day Scores, optimizer suggestions, blood-marker comparisons, and AI assistant outputs are informational. Do not treat another user’s screenshots of scores as diagnosis. Re-read the Medical Disclaimer and Automated Decisions.
5.4 Clinicians who participate
Licensed professionals who join as community members should not create a clinician–patient relationship via the forum unless they have an independent lawful care relationship offline. Identify conflicts of interest if recommending products (see also Advertising & Affiliate Disclosure).
6. User content you may post
6.1 UGC includes posts, replies, private messages (where enabled), profiles, avatars, uploads, links, and similar materials you submit to the Community.
6.2 You represent that you have the rights needed to post your UGC and that it does not violate law, these Guidelines, or others’ rights.
6.3 Sensitive self-disclosure. You choose what health information to share. Public categories are visible to other users and may be indexed or quoted according to platform settings. Prefer minimizing highly sensitive detail in public threads.
6.4 Custom ingredients and in-app UGC. Separately from the forum, the main app may allow user-created custom ingredients or similar content. IP complaints for that content are also covered under Copyright DMCA. Conduct rules in the Acceptable Use Policy still apply.
7. License-back to Being Optimal
7.1 Your ownership. As between you and Being Optimal, you retain ownership of your UGC (subject to others’ rights and third-party licenses).
7.2 License you grant. By submitting UGC to the Community, you grant [PENDING: LEGAL_ENTITY_NAME] a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to:
- Host, store, reproduce, display, perform, distribute, and transmit the UGC on and through the Community and related Services;
- Moderate, reformat, translate (including automated), and create technical adaptations (e.g., thumbnails, previews, search indexes) as needed to operate the forum;
- Use quotes or excerpts of public UGC for product improvement, safety, trust & safety, and — where public and not sensitive personal data in context — limited illustrative marketing of the Community itself (we will not sell your private messages as advertising creative).
7.3 Duration. The license lasts for the period your UGC remains on our systems and for reasonable residual copies in backups, caches, and legal archives. If UGC is deleted or anonymized, the license ends for public display going forward, subject to residual technical copies and legal holds.
7.4 Name and likeness. You grant us permission to display your chosen username/avatar with your UGC as part of normal forum operation.
7.5 Feedback. Product suggestions you post may be used by us without obligation to you.
7.6 This license does not allow us to claim you endorse a third-party product merely because you discussed nutrition generally.
8. Moderation
8.1 We may (but are not obligated to) monitor the Community. We may remove, edit, lock, move, or limit distribution of UGC; issue warnings; mute, suspend, or ban accounts; and report unlawful content to authorities.
8.2 Enforcement factors may include severity, intent, history, risk of harm (especially pregnancy-related), and legal risk.
8.3 Appeals. You may appeal a moderation action by contacting [email protected] with your username, link or description of the content, and why you believe the action was wrong. We aim to respond within a reasonable time; decisions after appeal are final except where law requires more process.
8.4 No duty to publish. The Community is a private venue we operate; there is no right to continued posting privileges.
8.5 Community Platform Provider tools. Spam filters, trust levels, flags, and automated defenses may apply per the platform’s design.
9. Reporting
9.1 In-forum. Use the platform’s flag/report controls where available.
9.2 Direct report. Email [email protected] (safety/abuse) or [email protected] (legal claims, IP — also see DMCA process) with:
- URL or topic title;
- Username(s) involved;
- Description of the issue;
- Screenshots if helpful;
- Your contact email.
9.3 Emergencies. For immediate danger, contact local emergency services first; then notify us if relevant to platform safety.
9.4 Copyright. Follow Copyright DMCA for infringement notices — do not use general flags alone for formal DMCA claims if you want the statutory process.
10. Privacy, retention, and account deletion (Community)
10.1 Community Personal Data handling is described in the Privacy Policy.
10.2 Honest erasure caveat: On Being Optimal account deletion, forum identity may be anonymized (e.g., display name/email cleared) rather than hard-deleting all historical posts and uploads. Content may remain visible in anonymized form; staff/moderation accounts may be treated differently; steps are best-effort. External backups and legal holds may retain data longer. Contact [email protected] for assistance.
10.3 Private messages and uploads may follow Community Platform Provider retention behavior.
11. Third-party links and commercial posts
11.1 Links to third-party sites are at your own risk. Being Optimal does not endorse linked content unless we explicitly say so.
11.2 Undisclosed affiliate or paid promotion violates these Guidelines. If we run Certified brand or partner programs, those are disclosed under Advertising Affiliate Disclosure.
12. Suspension of the Community
We may modify, suspend, or discontinue the Community (in whole or part) with or without notice, subject to mandatory law. UGC license terms survive as needed for wind-down and legal compliance.
