Acceptable Use Policy
1. Scope and incorporation
This Acceptable Use Policy (AUP) applies to all access to and use of the Services operated by [PENDING: LEGAL_ENTITY_NAME] (Being Optimal, Site Nutrition), including the planner, account surfaces, AI assistant, help/learning content, APIs used by the product, and community forum (where enabled).
This AUP is incorporated by reference into the Terms of Service. Capitalized terms follow Definitions.
If you disagree with this AUP, do not use the Services.
2. Permitted use
You may use the Services to:
- Create and maintain a personal account (age 18+)
- Log meals, combos, templates, and journal information for personal planning
- View educational content and informational scores/flags
- Use the AI assistant for personal, non-clinical informational guidance, subject to the Medical Disclaimer
- Participate in community discussion consistent with Community Guidelines
- Export available data for your own portability needs (subject to Privacy Policy scope limits)
- Contact support and exercise privacy rights in good faith
3. Prohibited uses — general
You may not use the Services to:
3.1 Unlawful and harmful activity
- Violate any applicable law or regulation
- Exploit, harm, or attempt to harm minors in any way
- Promote or facilitate violence, self-harm, or illegal drug manufacture
- Engage in fraud, identity theft, phishing, or social engineering
- Stalk, harass, threaten, dox, or defame others
- Infringe intellectual property, privacy, or publicity rights
3.2 Account and access abuse
- Share, sell, rent, or transfer accounts
- Create accounts by automated means or under false identity
- Circumvent suspension, rate limits, entitlement checks, or paywalls
- Access another user’s Environment, data, or community private content without authorization
- Impersonate Being Optimal staff, clinicians, or other users
3.3 Service integrity
- Interfere with or disrupt the Services, servers, or networks
- Introduce malware, ransomware, or malicious code
- Perform denial-of-service or traffic flooding
- Probe, scan, or test vulnerabilities except as expressly allowed in Section 8
- Bypass authentication, authorization, RLS boundaries, or encryption
- Mine cryptocurrency or run unrelated workloads on our infrastructure
3.4 Scraping, bulk extraction, and resale
- Scrape, harvest, or systematically download the food/nutrient catalog, Knowledge content, help corpus, or engine outputs at scale
- Use bots, spiders, or automated tools to extract data beyond ordinary interactive use (ordinary browser use and documented product features are fine)
- Resell, re-publish, or commercially redistribute our curated datasets, scoring logic, or non-public API responses
- Build a competing nutrition database primarily by copying Being Optimal content
- Remove proprietary notices or provenance metadata from exported materials you are otherwise allowed to keep for personal use
Fair use of public-domain nutrient source values for personal or academic purposes is not prohibited solely because those values also appear in our product; wholesale cloning of our compilation, UX, or non-public enrichment is prohibited.
3.5 Spam and commercial misuse
- Send spam or unsolicited promotions via community or messaging features
- Use the Services as a bulk marketing platform
- Manipulate partner/affiliate click measurement (fake clicks, incentivized click fraud)
3.6 Privacy invasion
- Upload others’ Personal Data or Special Category Health Data without a lawful basis and appropriate notices
- Attempt to re-identify pseudonymous analytics or outbound click records
- Collect information about other users for unauthorized profiling
4. AI assistant misuse
The AI assistant (“Borg” and any successor name) is an informational tool. In addition to Section 3, you may not:
4.1 Unsafe medical and clinical misuse
- Use the assistant as an emergency service or as a substitute for urgent clinical care
- Attempt to obtain dosing of prescription drugs, controlled substances guidance, or instructions to self-manage acute obstetric emergencies without seeking professional care
- Intentionally defeat safety filters, red-flag redirects, or system prompts to elicit dangerous medical instructions
- Generate content intended to discourage necessary prenatal care, vaccinations recommended by qualified clinicians, or emergency help when symptoms warrant it (lawful discussion of personal choices is not the same as campaigning to cause harm)
4.2 Jailbreaks and model abuse
- Jailbreak, prompt-inject, or otherwise manipulate the assistant to ignore safety rules
- Exfiltrate system prompts, hidden tools, or other users’ data via the assistant
- Use the assistant to generate malware, phishing kits, or exploit code
- Bypass rate limits or entitlement gates for AI features
4.3 Misinformation and scale abuse
- Generate bulk health misinformation campaigns for distribution off-platform
- Use the assistant to create deceptive “clinical looking” documents designed to mislead patients or providers
- Submit others’ sensitive health data into prompts without authorization
4.4 Acknowledge limitations
You agree that AI output can be wrong and that you will not represent AI text as professional medical advice or as Being Optimal’s clinical opinion. See Medical Disclaimer and Automated Decisions.
5. Community and user-generated content
Where community features are enabled (https://community.beingoptimal.org or in-product surfaces), you must also follow the Community Guidelines. Without limiting that document:
5.1 Conduct
- Be respectful; no hate speech, harassment, or bullying
- No sexually explicit content involving minors; no non-consensual intimate imagery
- No graphic violence or gore without a legitimate educational context moderated as appropriate
5.2 Health discussions
- Peer support is welcome; do not present yourself as a clinician unless you are one and clearly state your credentials and that you are not providing care through the platform
- Do not prescribe drugs or dosages to other users
- Do not run health misinformation campaigns (coordinated false claims designed to cause public health harm)
- Crisis content: encourage professional help; do not instruct methods of self-harm
5.3 Content rights
- Post only content you have rights to post
- No spam, scams, undisclosed affiliate schemes, or malware links
- Respect Copyright & DMCA Policy
5.4 SSO and identity
Community single sign-on receives identity fields necessary to create/link a forum profile. Do not attempt to coerce the platform into exporting other users’ health timeline data through community features.
6. Food catalog, engine, and research integrity
You may not:
- Falsify lab values, meal logs, or journal data for the purpose of defrauding research, insurance, employers, or clinical trials (personal imperfect logging is expected and not a violation)
- Misrepresent Day Scores, optimizer outputs, or blood-marker comparisons as certified clinical results
- Tamper with client-side code to fake entitlement status or scores for deceptive screenshots used commercially
Honest personal use, including incomplete logs, is expected and allowed.
7. Partner, brand, and affiliate integrity
If you interact with Certified brands or partner outbound links:
- Do not engage in click fraud or automated partner navigation
- Do not misrepresent endorsement by Being Optimal
- Follow Advertising & Affiliate Disclosure if you republish our materials with commercial intent (additional permission may be required)
8. Security research and vulnerability testing
We welcome good-faith security research under the Vulnerability Disclosure Policy.
8.1 Allowed (when you comply with the VDP)
- Research on systems you are authorized to test under the VDP scope
- Reporting vulnerabilities to [email protected]
- Using your own test accounts without accessing others’ data
8.2 Not allowed without prior written authorization
- Testing that degrades service for other users
- Accessing, copying, or exfiltrating real user Personal Data or Special Category Health Data
- Ransomware, extortion, or public disclosure before coordinated fix timelines in the VDP
- Social engineering of staff or users
- Physical attacks on data centers or offices
- Attacks on third-party sub-processors outside any scope they separately authorize
Unauthorized security testing is a violation of this AUP and may be a criminal offense. When in doubt, email [email protected] before testing.
9. Enforcement
9.1 Our rights
We may, with or without notice where appropriate:
- Remove or restrict User Content
- Rate-limit or throttle abusive clients
- Suspend or terminate accounts
- Revoke API or community access
- Report unlawful activity to law enforcement
- Pursue civil remedies
9.2 Factors
We consider severity, intent, history, impact on pregnancy-health users, and legal obligations.
9.3 Appeals
If you believe enforcement was in error, contact [email protected] or [email protected] with your account email and a brief explanation. We will review in good faith. Community moderation may have additional appeal paths on the forum host.
9.4 No obligation to monitor
We do not undertake a general obligation to monitor all User Content, but we may moderate as permitted by law (including notice-and-action regimes).

Order of precedence: see Terms § Order of precedence. This AUP controls for acceptable-use subject matter relative to general Terms prose.
12. Changes
We may update this AUP. Material changes will be noticed as described in the Terms. Continued use after the effective date constitutes acceptance where permitted by law.
