1. Purpose of this consent

This Electronic Communications Consent (Consent) explains how [PENDING: LEGAL_ENTITY_NAME] (Being Optimal, Site Nutrition) communicates with you electronically when you use Being Optimal / Site Nutrition (the Services) at https://beingoptimal.org and related domains.

By creating an account, agreeing to the Terms, or continuing to use the Services after notice of this Consent, you agree to the terms below to the extent permitted by law.

This Consent is incorporated into the Terms of Service. Defined terms follow Definitions.


2. Scope of electronic communications

2.1 Legal and contractual communications

You agree that the following may be provided electronically rather than on paper:

  • Terms of Service, Privacy Policy, Cookie Policy, Acceptable Use Policy, Medical Disclaimer, Billing Policy, Community Guidelines, and other legal suite documents
  • Updates, amendments, and re-acceptance prompts for those documents
  • Notices about material changes to features that affect your rights
  • Account suspension, termination, or policy-enforcement notices
  • Responses to privacy or consumer rights requests (as appropriate)
  • Any other disclosures required by law that may be delivered electronically

2.2 Transactional and service messages

While you maintain an account or use the Services, we may send:

2.3 Community and education

If you use community or learning features, you may also receive forum notifications per Community Platform Provider settings you control on https://community.beingoptimal.org.

2.4 Marketing messages

Marketing or promotional emails (if any) will be sent only where permitted by law and, where required, with separate consent or soft opt-in rules. Marketing messages will include an unsubscribe mechanism. Transactional messages are not marketing and may not include an unsubscribe that disables security or account-critical mail.

As of this draft, Being Optimal’s primary communications are transactional and product-operational, not high-volume marketing campaigns. If CRM marketing expands, we will update this Consent and the Privacy Policy as needed.


3. Delivery methods and providers

3.1 Email

Transactional email is sent using our Email Delivery Provider. Messages may include your email address and limited account or notification content. Provider logging and retention follow the provider’s practices and our Privacy Policy (external retention caveats apply).

Email template design may use an Email Design Provider on the operator side; that tooling is not a consumer messaging channel by itself.

3.2 In-product notices

We may present banners, modals, or account-page notices within the signed-in shell or public site.

3.3 Push notifications

Optional notifications use browser Web Push (VAPID). We do not use a separate third-party consumer push SaaS for standard product push. Enabling push requires browser permission. See Cookie Policy.

3.4 Authentication Provider messages

The Authentication Provider may send its own authentication emails (magic links, verification, security). Those messages are governed by this Consent as part of using our sign-in system and by the provider’s terms.

3.5 No default SMS

We do not currently rely on SMS as a primary channel. If SMS is added, we will obtain any required consent and update this document.


4. Hardware and software requirements

To receive electronic communications, you need:

  • A device with internet access
  • A current browser capable of using the Services (and, for push, a browser that supports Web Push)
  • A valid email address you control
  • Sufficient storage to retain copies of notices you wish to keep
  • The ability to print or save PDFs/HTML if you want offline copies

If you cannot meet these requirements, you may be unable to contract electronically for the Services. Contact [email protected] to discuss accessibility alternatives (see Section 7).


5. Your email address and keeping information current

You agree to:

  • Provide a valid email address at registration
  • Keep your email address current in account settings / Authentication Provider profile
  • Monitor that inbox (and spam folders reasonably) for security and account messages

We are not responsible for harm caused by your failure to maintain a working email address, except where mandatory law provides otherwise.


6. Consent to electronic delivery; ESIGN acknowledgment

6.1 Consent

You affirmatively consent to receive the communications described in this Consent in electronic form. You acknowledge that your electronic acceptance of Terms and related policies (including clickwrap when implemented) has the same legal effect as a handwritten signature where allowed by law (including the U.S. ESIGN Act and UETA, as applicable, and analogous laws elsewhere).

6.2 Record retention

We may retain electronic records of acceptances, notices, and key transactional emails as needed for legal, security, and operational purposes. Target acceptance logging is described in Versioning And Acceptance. Implementation status: versioned acceptance ledger may not yet be fully wired; counsel and engineering should not overclaim cryptographic proof of acceptance until implemented.

6.3 Withdrawal of electronic delivery consent

You may withdraw consent to electronic delivery of legal notices by contacting [email protected] or [email protected] and closing your account if paper delivery is not offered.

Important consequences of withdrawal:

  • We may not be able to continue providing the Services to you, because the Services are digital-first and require electronic notices
  • Withdrawal does not affect the legal effectiveness of records provided electronically before withdrawal
  • Account-critical security emails may still be necessary during wind-down

6.4 Marketing withdrawal

You may unsubscribe from marketing emails via the link in those emails without closing your account.

6.5 Push withdrawal

Disable notifications in your browser/OS and/or product notification settings. You may also delete push subscriptions by clearing site data or closing your account (subject to Privacy Policy deletion caveats for orphan notification tables).


7. Paper copies and accessibility

7.1 No default paper program

Paper copies are not provided by default. The Services are designed for electronic delivery.

7.2 On request

You may request a copy of a specific legal document by emailing [email protected]. We may provide:

  • A link to the current HTML/markdown-rendered policy on https://beingoptimal.org/legal/*
  • A PDF or plain-text export when reasonably available

We reserve the right to refuse unreasonable bulk requests or to charge a fee only where permitted by law for repeat paper fulfillment (we do not currently operate a paper fulfillment desk).

7.3 Accessibility

8. Timing and deemed receipt

Electronic communications are deemed received when:

  • Email: when sent to the email address on your account (or when made available, for provider-hosted auth messages), whether or not you actually open them
  • In-product: when displayed in the Services while you are signed in or on the public page
  • Push: when delivered to the push service for your subscription (actual device display depends on your device settings)

These rules apply except where mandatory law requires a different standard.


9. Privacy

Electronic communications involve processing of Personal Data (email address, notification content, device push endpoints, interaction metadata). Processing is described in the Privacy Policy. Email Delivery Provider and Authentication Provider roles are listed in the Sub-processor List.


10. Conflict with other documents

If this Consent conflicts with the Terms on a pure communications-delivery topic, this Consent controls for that topic. Billing-message content may also be governed by the Subscription, Billing & Refund Policy and Billing Provider terms. Mandatory consumer law prevails.


11. Changes

We may update this Consent. Material changes will be noticed electronically under the updated process. Continued use after the effective date constitutes acceptance where permitted.
